These Terms of Service (“Terms”) govern your access to and use of the AskFriday analytics assistant (“Service”) operated by Friday Intellytics (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

2. Description of Service

AskFriday is an AI-powered analytics assistant that enables you to:

• Query connected BigQuery datasets using natural language
• Generate SQL queries, visualizations, and data insights
• Create and manage workspaces for organizing conversations
• Pin visualization artifacts and publish shared dashboards
• Import and analyze Kaggle datasets

The Service uses Google Vertex AI (Gemini) to process queries and generate responses. Outputs are AI-generated and may not always be accurate, complete, or suitable for your needs.

3. Accounts and Authentication

• You sign in using Google Authentication. You are responsible for maintaining the security of your Google account.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information and keep your account credentials secure.
• You must notify us immediately at datasecurity@fridayintellytics.com if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to the Service, other accounts, or connected data sources you do not have permission to access
• Query, extract, or export data you are not authorized to access
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Circumvent rate limits, authentication, or any security measures
• Use the Service to generate harmful, misleading, or fraudulent content
• Introduce malicious code, viruses, or interfere with the Service’s operation
• Use automated scripts, bots, or scrapers to access the Service without prior written consent
• Resell, sublicense, or commercially redistribute the Service or its outputs without prior written consent
• Use the Service in a manner that could damage, disable, or impair its functionality or interfere with other users’ access

We reserve the right to suspend or terminate your access for any violation of these Terms.

5. Your Data

5.1 Ownership

You retain all rights to the data you connect to and query through the Service. We do not claim ownership of your datasets, queries, or results.

5.2 License to Us

By using the Service, you grant us a limited, non-exclusive license to access, process, and store your data solely as necessary to provide and improve the Service. This license terminates when you delete your data or account.

5.3 Shared Dashboards

When you publish a shared dashboard, it becomes accessible to anyone with the link. You are responsible for ensuring you have the right to share the data contained in those dashboards. We are not responsible for how others use data you choose to share.

5.4 Privacy

Your data is handled in accordance with our Privacy Policy. By using the Service, you also agree to the terms of our Privacy Policy.

6. AI-Generated Content

6.1 No Guarantee of Accuracy

The Service uses AI to generate SQL queries, data analyses, visualizations, and text responses. These outputs are provided “as is” and may contain errors, inaccuracies, or inappropriate content. You are solely responsible for reviewing and validating all AI-generated outputs before relying on them.

6.2 Not Professional Advice

AI-generated outputs do not constitute financial, legal, medical, or other professional advice. Do not make business-critical decisions based solely on outputs from the Service without independent verification.

6.3 Output Ownership

You own the outputs generated through your use of the Service (queries, visualizations, insights), subject to any rights in the underlying data.

7. Third-Party Services

The Service integrates with third-party services including Google Cloud Platform and Kaggle. Your use of these services is governed by their respective terms:

We are not responsible for the availability, accuracy, or practices of third-party services.

8. Service Availability and Limits

8.1 Availability

We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

8.2 Usage Limits

The Service enforces the following limits:

• 10 workspaces per user
• 200 messages per workspace
• Rate limits on API requests to ensure fair usage

We may modify these limits at any time. Exceeding limits may result in temporary throttling or restricted access.

8.3 Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will make reasonable efforts to notify active users of material changes.

9. Intellectual Property

9.1 Our Rights

The Service, including its software, design, branding, documentation, and underlying technology, is owned by Friday Intellytics and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

9.2 Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us a non-exclusive, royalty-free, perpetual license to use and incorporate that feedback without obligation to you.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY, RELIABILITY, OR COMPLETENESS OF AI-GENERATED OUTPUTS
• UNINTERRUPTED OR ERROR-FREE OPERATION
• SECURITY OF DATA TRANSMISSION OR STORAGE

YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FRIDAY INTELLYTICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY
• DAMAGES ARISING FROM AI-GENERATED OUTPUTS, INCLUDING INCORRECT SQL QUERIES OR DATA ANALYSES
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR DATA
• INTERRUPTION OF SERVICE

OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless Friday Intellytics, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Data you share through published dashboards

13. Termination

13.1 By You

You may stop using the Service at any time. To delete your account and data, email datasecurity@fridayintellytics.com.

13.2 By Us

We may suspend or terminate your access at any time, with or without cause, with or without notice. Reasons for termination include but are not limited to violation of these Terms, abusive behavior, or extended inactivity.

13.3 Effect of Termination

Upon termination:

• Your right to access the Service ceases immediately
• We may delete your data in accordance with our Privacy Policy
• Sections 5.1, 6, 9, 10, 11, 12, and 14 survive termination

14. General Provisions

14.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts in Chennai, India.

14.3 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Friday Intellytics regarding the Service.

14.4 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

14.5 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.6 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the “Last updated” date at the top of this page
• Notify active users via email or in-app notice

Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
